Indigenous Peoples' Rights (Gladue)

We at Black Criminal Law take special care when assisting those who identify as Indigenous within the Justice System. Under Canadian law, courts must consider the unique circumstances of Indigenous people. This is called the Gladue Principle.

We will advocate for culturally appropriate and restorative options whenever possible. To accomplish this, we gather the unique information regarding your background, community, experiences with colonialism, displacement or systemic issues. We ensure all these factors are heard before the court.

When appropriate, we then will connect you with a Gladue writer to prepare a Gladue Report. The purpose of the Glade Report is to help the Judge understand how your unique experiences as an Indigenous person have played a role in bringing you before the court. The Report allows the Court to see you as a whole person, not just the offence.
