Breaches & Administration of Justice

Breach charges arise when individuals violate court-imposed conditions or orders. If you're facing breach allegations in Kingston, Napanee, Brockville, or Belleville, understanding how seriously these charges are treated is essential.
Types of Administration of Justice Offences
Failure to Comply with Release Order (Bail Breach): Violating any condition of bail including missing curfew, contacting prohibited persons, failing to report, consuming alcohol when prohibited, or breaching any other condition.
Failure to Attend Court: Not appearing for required court dates. This is a separate criminal offence carrying up to two years imprisonment.
Failure to Comply with Probation Order: Violating probation conditions after sentencing, including failing to report, missing counseling, or breaching any probation terms.
Failure to Comply with Conditional Sentence Order (CSO): Violating house arrest or other conditional sentence conditions.
Breach of Undertaking: Violating conditions of police-issued undertakings or recognizances.
Each breach is a separate criminal offence added to existing charges.
Moving Forward
Breach and administration of justice charges are taken extremely seriously by Ontario courts. They often have more immediate impact than underlying charges, resulting in detention and eliminating resolution options. Understanding your conditions, complying strictly with them, and seeking variations when necessary is essential.
If you're facing breach allegations in Eastern Ontario, understanding what the Crown must prove, the serious consequences of breach convictions, and how they affect your underlying charges is critical to addressing your situation.
